Judge Nancy Hernández López: Water as a Human Right

 

San José, Costa Rica, April 27, 2022

 

Judge Nancy Hernández López gave the main speech at the presentation of the book Water as a human right: Acknowledgments and disputes in Costa Rica, edited by researchers Evelyn Villarreal and Bruce Wilson, with a prologue written by the Inter-American Court Judge.

At the launch event, Judge Nancy Hernández López highlighted that: "the book makes the human right to water visible as part of a new generation of rights in the face of the needs and threats of our era, but which at the same time require authentic enforceability for their realization, so that they do not become a mere semantic declaration or paper rights”. She therefore encouraged serious reflection on at least two specific issues: “the need to update legislation and evidence citizen participation in the issue.”

"Access to water, its management and protection, exemplifies the role as a fundamental release valve of social tension in structural issues where the State fails and where, increasingly, communities resort to the complexities of the Constitutional Court in search of solutions to the mismanagement of water resources," said Judge Hernández López. 

In the publication’s prologue, the Judge highlighted that she hopes that: "the work adds voices and manages to mobilize intentions so that the issue of water access, protection and quality becomes a priority on the country's public agenda once again”.
