ADVISORY OPINION 31 OF 2025:
THE CONTENT AND SCOPE OF CARE AS A HUMAN RIGHT AND ITS INTERRELATIONSHIP WITH OTHER RIGHTS

On January 20, 2023, the government of the Republic of Argentina submitted a request to the Inter-American Court of Human Rights for an Advisory Opinion on the content and scope of care as a human right, and its interrelationship with other rights, based on Article 64(1) of the American Convention on Human Rights and in conformity with Articles 70(1) and 70(2) of the Rules of Procedure of the Court.

The Registrar’s Office of the Court forwarded the request to the OAS member States and other pertinent bodies, and invited individuals and organizations interested in presenting written observations. A total of 129 briefs were received from 267 actors, including States, international bodies, national institutions, communities, civil society organizations, academic institutions, and individuals.

Once the written procedure was concluded, a public hearing was held at the seat of the Inter-American Court of Human Rights in San José, Costa Rica, on March 12, 13 and 14, 2024. A total of 67 delegations appeared before the Court. The Advisory Opinion was deliberated by the judges of the Court during its sessions in April, May and June 2025, and it was adopted on June 12, 2025. Lastly, Advisory Opinion 31 of 2025 was notified on August 07 2025.

ADVISORY OPINION 32 OF 2025:
CLIMATE EMERGENCY AND HUMAN RIGHTS

On January 9, 2023, the governments of the Republic of Chile and the Republic of Colombia submitted a request to the Inter-American Court of Human Rights for an advisory opinion on the obligations of States in responding to the climate emergency, based on Article 64(1) of the American Convention on Human Rights and in conformity with Articles 70(1) and 70(2) of the Rules of Procedure of the Court.

The Registrar’s Office of the Court forwarded the request to the OAS member States and other pertinent bodies, and invited individuals and organizations interested in presenting written observations. A total of 263 briefs were received from 613 actors, including States, international bodies, national institutions, communities, civil society organizations, academic institutions, one company and individuals.

Once the written procedure was concluded, two public hearings were held: the first in Bridgetown, Barbados, on April 23, 24 and 25, 2024; the second in Brasilia, on May 24, and in Manaos, on May 27, 28 and 29. A total of 185 delegations appeared before the Court. The Advisory Opinion was deliberated by the judges of the Court during its sessions in February, March, April and May 2025, and it was adopted on May 29, 2025. Lastly, Advisory Opinion 32 of 2025 was notified on July 3, 2025.
