I/A Court H.R. archived the Case of Ximenes Lopes v. Brazil

 

San José, Costa Rica, October 28th, 2023.- In conformity with that set forth in the Order of Monitoring Compliance with Judgment issued on September 25th, 2023, the Court has concluded the Case of Ximenes Lopes, given that Brazil complied with the four reparation measures ordered in the Judgment of July 4th, 2006, and the Court declared the conclusion of the monitoring of compliance with the obligation to investigate, prosecute and, if applicable, punish those responsible for the facts of this case. For more information, the Judgment of July 4th, 2006, can be accessed here and the Order of September 25th, 2023, which declares the archiving of the case, can be accessed here.

  • La Corte Interamericana de Derechos Humanos celebrará su 168 Período Ordinario de Sesiones

    San José, Costa Rica, junio 15 de 2024. – La Corte Interamericana de Derechos Humanos celebrará entre el 17 a 21 de junio y del 1 a 5 de julio de 2024 su 168 Período Ordinario de Sesiones. Durante el mismo se llevarán a cabo las deliberaciones de Sentencia de cuatro Casos Contenciosos en estudio, se deliberará una Sentencia de Interpretación, y se celebrarán tres Audiencias Públicas y una Audiencia Privada de Supervisión de Cumplimiento de Sentencia.

  • Argentina is responsible for failures in its duty of prevention and due diligence in the investigation of the AMIA attack

    San José, Costa Rica, June 14, 2024. - In the Judgment notified today in the Case Asociación Civil Memoria Activa Vs. Argentina, the Inter-American Court of Human Rights found the State of Argentina responsible for not having adopted reasonable measures to prevent the terrorist attack that occurred on July 18, 1994, as well as for not having fulfilled its duty to investigate the attack and its cover-up with due diligence and within a reasonable time frame. The Court also declared Argentina's responsibility for not having guaranteed real access to documentation regarding the attack. Likewise, it was determined that Argentina violated the right to truth due to the multiple shortcomings of the State in determining the historical truth about the attack and its direct responsibility in the cover-up maneuvers, as well as the difficulties faced by the victims' families in accessing information about the case.

  • La Corte Interamericana de Derechos Humanos celebró su 167 Período Ordinario de Sesiones

    San José, Costa Rica, junio 10 de 2024. – La Corte Interamericana de Derechos Humanos realizó su 167 Período Ordinario de Sesiones entre el 20 de mayo y el 7 de junio de 2024. Las primeras dos semanas de Sesiones se llevaron a cabo en Brasil, Brasilia y Manaos respectivamente.  Se realizaron audiencias públicas en la Opinión Consultiva sobre Emergencia Climática y Derechos Humanos y en el Caso Adolescentes Recluidos en Centros de Detención e Internación Provisoria del Servicio Nacional de Menores (SENAME) Vs. Chile. Adicionalmente, se desarrolló la Ceremonia de Inauguración del Período Sesiones, un Seminario Internacional, tres Audiencias Privadas de Supervisión de Cumplimiento de Sentencia, la firma de cinco Convenios de Cooperación y varias visitas protocolarias, como se informó anteriormente.

  • Inter-American Court of Human Rights translates judgments and advisory opinions into English and Portuguese thanks to the support of Sweden

    San José, Costa Rica, May 29, 2024- The Inter-American Court of Human Rights with the support of the Swedish International Development Cooperation Agency (SIDA) has made available on its website the translation of 33 judgments into English. One judgment and one advisory opinion were also translated into Portuguese.

  • The Inter-American Court Of Human Rights opens its 167th Regular Session at the supreme federal court

    Brasilia, May 20, 2024. - On Monday, the full session of the Supreme Federal Court (STF) hosted the opening of the 167th Regular Session of the Inter-American Court of Human Rights (I/A Court H.R.). In the opening ceremony, the President of the STF, Minister Luís Roberto Barroso, and the President of the Inter-American Court of Human Rights, Judge Nancy Hernández, highlighted the importance of the protection of the environment and democracy to guarantee the fundamental rights of citizens.

  • El Salvador is responsible for forced disappearances during the armed conflict: Case of Cuéllar Sandoval et al.

    San José, Costa Rica, May 16, 2024. - In the Judgment notified today in the Case of Cuéllar Sandoval et al. v. El Salvador, the Inter-American Court of Human Rights declared the State of El Salvador responsible for the forced disappearance of Patricia Emilie Cuéllar Sandoval, Mauricio Cuéllar Cuéllar and Julia Orbelina Pérez. It also concluded that the disappearance of Patricia Emilie Cuéllar Sandoval was a violation of the right to defend human rights, and declared the responsibility of El Salvador for the effects on the victims’ next of kin.

  • El Salvador found responsible for violating rights to judicial guarantees and judicial protection

    San José, Costa Rica, May 16, 2024. - In the Judgment of the Case of Aguirre Magaña v. El Salvador, notified today, the Inter-American Court of Human Rights, in consideration of the facts and in view of the State’s acknowledgment of its international responsibility, declared El Salvador responsible for the violation of the rights to judicial guarantees and judicial protection to the detriment of Miguel Ángel Aguirre Magaña, due to the fact that the State failed to comply with its obligations to act with due diligence and guarantee a reasonable period of time. Mr. Aguirre also did not have an effective remedy to guarantee his rights.

  • Honduras is internationally responsible for the arbitrary removal of four justices from the Constitutional Chamber Of The Supreme Court Of Justice Of Honduras

    San José, Costa Rica, April 1st, 2024.- In the Judgment notified today in the case of Gutiérrez Navas et al. v. Honduras, the Inter-American Court of Human Rights declared the international responsibility of the State of Honduras for the violation of judicial guarantees, the principles of freedom from ex post facto laws and independence of the judiciary, as well as the right to participate in government, right to judicial protection, job security and personal integrity of the justices José Antonio Gutiérrez Navas, José Francisco Ruiz Gaekel, Gustavo Enrique Bustillo Palma and Rosalinda Cruz Sequeira (hereinafter “the victims”). The State partially acknowledged its international responsibility in the instant case.
